Employee, Contractor or Volunteer? Getting the relationship right - West Leederville
You may have noticed that HR managers at not-for-profit organisations are increasingly taking on responsibility for volunteers. But how can you be sure someone is, in fact, a volunteer? What if they’re actually an employee or a contractor?
The consequences of characterising the relationship incorrectly can be significant. Not-for-profits could be hit with claims for unpaid wages and other employment entitlements, sham contracting, breach of contract, unfair dismissal and adverse action. Not to mention exposure to risks around tax, superannuation, insurance, workplace safety and health obligations and vicarious liability for actions of volunteers.
To help you get the relationship right, Kylie Groves, Partner and Scott Meacock, Special Counsel at Hall & Wilcox will be presenting a seminar on the characteristics of each type of relationship, what you need to watch out for and steps you can take to mitigate risk.
